Official Appeal to NEURC, the Ministry of Energy of Ukraine, the Ministry of Economy, Environment and Agriculture of Ukraine, and the Verkhovna Rada Committee on Energy and Housing and Communal Services

Today, the Public Association Energy Union officially addressed NEURC, the Ministry of Energy of Ukraine, the Ministry of Economy, Environment and Agriculture of Ukraine, and the Verkhovna Rada Committee on Energy and Housing and Communal Services regarding the need to unify approaches to the procurement and sale of electricity by active consumers.

Our appeal concerns the resolution of legal conflicts between public procurement legislation and energy legislation, particularly in relation to the mechanism of self-generation. We emphasized that the current legal uncertainty creates risks for budgetary institutions and other active consumers who have invested in their own generation (e.g., solar power plants) and are facing difficulties in selling surplus electricity through Prozorro.

In our letter, we proposed to:

  • Develop clear mechanisms and methodological guidelines;
  • Introduce amendments to current legislation to ensure the legality of simultaneous electricity procurement and sale within public procurement, without creating risks for consumers and suppliers.

We expect official responses from all addressees and are ready to contribute to joint work on changes that will ensure transparency, efficiency, and sustainable development of Ukraine’s competitive energy market.
