Public Association “Energy Union” appeals to the NEURC on aligning the Retail Electricity Market Rules with updated legislative requirements regarding active consumers

Following the entry into force of amendments introduced by Law of Ukraine No. 4777-IX dated 10 February 2026, the Public Association “Energy Union” has addressed the Regulator with a request to regulate the application of the new settlement model for active consumers.

This concerns business entities, including those applying the simplified taxation system, that generate electricity for their own needs and have the right to feed surplus volumes into the grid.

The updated legislative provisions introduce the possibility of settling accounts for supplied and consumed electricity without applying a netting mechanism, i.e. through separate accounting of electricity purchase and sale transactions.

However, the current Retail Electricity Market Rules and standard contract templates are still based on the previous settlement model, which in practice creates legal uncertainty for electricity suppliers, universal service suppliers, and active consumers.

In its appeal, the Public Association “Energy Union” requests the National Energy and Utilities Regulatory Commission of Ukraine to:

  • bring the Retail Electricity Market Rules into compliance with current legislation;
  • provide official clarifications on the temporary application of the new settlement model prior to the introduction of formal amendments;
  • ensure appropriate conditions for the practical implementation of the rights of active consumers.

Taking into account the statutory timelines for preparing the relevant regulatory amendments, the Association also emphasizes the importance of resolving this issue as soon as possible, with due consideration of the practical needs of market participants.

Timely updating of the regulatory framework will contribute to the development of self-generation, support for small and medium-sized businesses, as well as increased legal certainty in the retail electricity market.
