On 28 May 2026, the Public Association “Energy Union” held a professional online meeting for electricity suppliers.

The special guest of the event was Yaroslava Dubrova, a practicing lawyer specializing in public procurement and the author of a dedicated training course.

During the meeting, participants discussed the fact that the Verkhovna Rada of Ukraine had adopted a new version of the Law of Ukraine “On Public Procurement” just one day earlier. Following the President’s signature, the Law will enter into force in nine months, after which market participants will operate under the new regulatory framework.

During this transition period, the development of methodological guidelines, an implementation roadmap, and more than 40 secondary legislative acts is expected in order to implement the requirements of the new Law. Therefore, market participants should already begin a detailed analysis of the forthcoming changes, develop proposals, and prepare submissions to the relevant authorities regarding practical aspects that should be taken into account to ensure the stable functioning of the market.

Particular attention during the meeting was devoted to issues related to changes in contract prices under public procurement agreements, the risks associated with concluding supplementary agreements, and the liability of the parties involved.

As noted during the discussion, every supplementary agreement in the supply of electricity, natural gas, or fuel now requires a solid legal justification and proper documentary support, as price adjustment issues are increasingly becoming the subject of inspections by regulatory authorities, court proceedings, and even criminal investigations.

Ms. Dubrova presented her proprietary training course:

“Changing the Price of Goods in a Contract: Legal Aspects and Risk Prevention.”

The meeting covered the following topics:

  • practical experience in concluding supplementary agreements;
  • risks and inspections by supervisory authorities;
  • court practice in the field of public procurement;
  • current challenges faced by electricity suppliers;
  • expected amendments related to the new Law of Ukraine “On Public Procurement”.
