The Chamber of Commerce of Ukraine and the State Tax Service Agree on a Unified Approach to Certifying Force Majeure Events

ATTENTION! The Chamber of Commerce of Ukraine and the State Tax Service of Ukraine have agreed on a unified approach to certifying force majeure events (circumstances of insurmountable force).

This is important news for businesses, especially under martial law and amid the unstable operation of the energy system.

What this means in practice:

  • TCC certificates must now clearly establish the cause-and-effect link between the force majeure event and the impossibility of fulfilling obligations;
  • The actual duration of the force majeure event must be specified;
  • Greater standardization — fewer disputes with tax authorities.

With proper documentation, businesses may be exempt from liability for:

  • Late registration of tax invoices;
  • Late payment of tax obligations;
  • Tax debts arising due to force majeure.

The goal of these changes is to establish a unified practice and reduce conflicts between businesses and regulatory authorities.

It is recommended to take these approaches into account in business operations and, if necessary, to timely document the impact of force majeure events on company activities.
