Continuation of an important discussion on the retail electricity market

Following our previous publication on incentive coefficients and the problematic aspects of the mechanism’s application, the discussion has shown one thing: the market has more questions than answers.

Today, an official step has been introduced that allows not only discussion and criticism, but also the submission of proposals. Therefore, we encourage you to join the consultation process and provide specific proposals to the NEURC.

A draft resolution with features of a regulatory act has been published — amendments to the Temporary Procedure for determining the volumes of electricity purchases in the electricity market by electricity suppliers and distribution system operators during the transitional period.

The National Commission for State Regulation of Energy and Public Utilities (hereinafter – NEURC) has published a draft with features of a regulatory act — the draft resolution of the NEURC “On Approval of Amendments to the Temporary Procedure for Determining the Volumes of Electricity Purchases in the Electricity Market by Electricity Suppliers and Distribution System Operators during the Transitional Period.”

By Resolution No. 2118 dated December 28, 2018, the NEURC approved the Temporary Procedure for determining the volumes of electricity purchases in the electricity market by electricity suppliers and distribution system operators during the transitional period (hereinafter – the Temporary Procedure).

In connection with appeals submitted to the NEURC by the Lviv Regional Military Administration (letter dated October 31, 2025 No. 5/20-11751/0/2-25/1-30.1.2), PJSC “Kharkivenerhozbut” (letter dated November 3, 2025 No. 01-15/6546), and LLC “Energy 365” (letters No. 1351 dated September 16, 2025 and No. 1578 dated October 22, 2025) regarding the need to amend the Temporary Procedure in the following areas:

  • postponement of deadlines for the implementation of smart meters for commercial metering points of Group “A” for enterprises, institutions, and organizations financed from the state and local budgets;
  • calculation of incentive coefficients;
  • establishment of an allowable deviation of ±5% between operational and actual data for commercial metering points of Group “A”.

In order to ensure the stable functioning of enterprises, institutions, and organizations financed from the state and local budgets, to regulate their expenditures for consumed electricity for Group “A” commercial metering points, to establish the maximum allowable level of deviation between operational and actual data for such metering points, and to introduce a centralized calculation of incentive coefficients, it is necessary to update the provisions of the Temporary Procedure.
