The Verkhovna Rada of Ukraine Has Approved Draft Law No. 11520 “On Public Procurement”

On May 27, 2026, the Verkhovna Rada of Ukraine approved Draft Law No. 11520 “On Public Procurement”. Following its signing by the President of Ukraine, the new public procurement rules are expected to come into effect in approximately 9 months.

This is one of the key laws in the sphere of Ukraine’s European integration, implementing the provisions of EU Directive 2014/24/EU and significantly changing the approaches to conducting tenders.

Main changes include:

  • Regulating the mechanism of dividing procurements into lots to expand the participation of small and medium-sized businesses;
  • The possibility of submitting alternative tender proposals with one’s own technical solutions;
  • Updating the rules for framework agreements and dynamic purchasing systems;
  • Clear regulation of subcontracting and interaction with co-executors;
  • Aligning the Ukrainian procurement system closer to European standards.

For electricity suppliers and energy market participants, this implies the need to start analyzing future changes right now, as well as revising approaches to tender participation, pricing mechanisms, risk management, and contractual work.

The Public Association “Energy Union” will continue its work on analyzing the new legislation and, after the official signing of the law, will organize a dedicated professional meeting for Union members regarding the practical application of the new procurement rules in the electricity sector.
