We would like to inform you that the Grand Chamber of the Supreme Court has scheduled a hearing in Case No. 920/19/24 for May 21, 2025, at 12:00. The case will be considered under the simplified lawsuit procedure.
The case concerns a highly important legal issue commonly referred to as the “10% Prozorro Rule.” According to the legal position outlined in the Grand Chamber’s ruling of January 24, 2024 (Case No. 922/2321/22), the increase in the price of goods under a public procurement contract may not exceed 10% of the initial contract value, regardless of how many times or at what intervals the changes are made during the term of the agreement.
This creates serious risks for electricity suppliers serving the public sector, especially under martial law conditions and amid significant price volatility in the electricity market.
That is why this case holds exceptional public and market significance and requires the establishment of a uniform legal practice.
Given the relevance of this issue, we encourage all market participants to join in the discussion and monitoring of the case.
